Welcome to Joyoverse. These Terms of Service (“Terms”) constitute a legal agreement between you (“User,” “Parent,” or “Guardian”) and Joyoverse (“we,” “us,” or “our”) governing your use of the Joyoverse website, our AI-integrated physical toy, and the Joyoverse mobile application (the “App”).

1. OVERVIEW & ACCEPTANCE

By purchasing our products or accessing our App, you agree to be bound by these Terms, including those additional terms and conditions and policies referenced herein. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services.

2. PARENTAL CONSENT & ELIGIBILITY

The Joyoverse App and its monitoring features are intended for use strictly by adults (18+).

  • Authorization: By setting up the Joyoverse toy and App, you affirm that you are the parent or legal guardian of the child using the toy.

  • Compliance: You consent to the processing of your child’s voice data and conversation logs as detailed in our Privacy Policy, which is designed to comply with the Children’s Online Privacy Protection Act (COPPA).

3. THE AI SERVICE & PARENTAL MONITORING

  • Purpose: Joyoverse provides an AI-integrated toy designed for interactive play and as an alternative to screen time.

  • Monitoring Feature: The App provides a dashboard for parents to track and review summaries of the conversations between the child and the toy. This feature is intended for safety and developmental tracking only.

  • AI Limitations: You acknowledge that generative AI can occasionally provide inaccurate information. Joyoverse is an entertainment and educational tool; it is not a substitute for professional medical, psychological, or educational advice.

  • Safety Filters: We employ rigorous safety filters to ensure age-appropriate interactions; however, parents are encouraged to use the monitoring dashboard to oversee their child’s experience.

4. USER CONDUCT

You agree not to use the Service to:

  • Monitor any child for whom you do not have legal guardianship.

  • Circumvent or disable any security-related features of the App or toy.

  • Use the AI to generate or encourage harmful, illegal, or inappropriate content. Failure to comply with these rules may result in immediate termination of your account without a refund.

5. ONLINE STORE & SUBSCRIPTIONS

  • Product Accuracy: We strive to display the colors and features of our physical toys as accurately as possible. However, we cannot guarantee that your device's display of any color will be accurate.

  • Shopify Subscriptions: Any subscriptions for Joyoverse services (such as extended AI features or data history) are managed and billed directly through our online store powered by Shopify.

  • Billing & Auto-Renewal: By purchasing a subscription, you authorize Joyoverse to charge your chosen payment method on a recurring basis. Subscriptions will automatically renew at the end of each billing cycle unless you cancel them through your Joyoverse customer account portal at least 24 hours before the next scheduled billing date.

  • No App Store Billing: Our mobile applications do not utilize Apple (iTunes) or Google Play in-app purchases for subscriptions. All financial transactions are centralized through our website to ensure a unified customer experience.

6. INTELLECTUAL PROPERTY

All content included in the Service, such as text, graphics, logos, and the software driving the AI toy, is the property of Joyoverse and is protected by copyright and intellectual property laws.

7. LIMITATION OF LIABILITY

Joyoverse, our directors, or employees shall not be liable for any injury, loss, claim, or any direct or indirect damages of any kind arising from your use of the toy or App. This includes, but is not limited to, errors in AI-generated content or service interruptions.

8. INDEMNIFICATION

You agree to indemnify and hold harmless Joyoverse from any claim or demand made by any third party due to your breach of these Terms or your violation of any law or the rights of a third party.

9. GOVERNING LAW

These Terms and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the jurisdiction in which Joyoverse is registered.
